Terms of Use

These Terms of Use (“Terms”) govern your use of the Netly VPN iOS application (the “App”) provided by Netly LLC (“we”, “us”). By downloading or using the App, you agree to these Terms.

1. The service

The App is a VPN client for iOS. Access requires a valid account key. Available locations and connection options depend on your account status and our infrastructure. We may change, suspend, or discontinue features with reasonable notice when practicable.

2. Accounts

You are responsible for keeping your account key confidential and for activity under your account. You may sign out or delete your account in the App settings. We may suspend or terminate access if we reasonably believe these Terms are violated or if required for security or legal reasons.

3. Acceptable use

You agree not to use the App to:

• violate applicable law;
• abuse, disrupt, or overload networks or our infrastructure;
• distribute malware, spam, or infringing content;
• attempt unauthorized access to systems or accounts;
• resell or misuse the service in a way that harms other users or the service.

4. Privacy

Our Privacy Policy describes what data we collect and how we use it. For VPN apps, we commit that we do not sell, use, or disclose user data to third parties for advertising or similar purposes, and we do not monetize VPN traffic contents.

5. Intellectual property

The App, branding, and related materials are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the App on Apple devices you own or control, subject to the App Store terms and these Terms.

6. Third-party services and Apple

Your use of the App is also subject to Apple’s App Store terms. Apple is not responsible for the App or its content. Questions about the App should be directed to us, not Apple, except where Apple’s terms say otherwise.

7. Disclaimer

The App is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, secure, or error-free operation, or that a particular location will always be available.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App is limited to the greater of (a) the amount you paid us for the App/service in the 12 months before the claim, or (b) USD 50, if no such payment applies.

9. Changes

We may update these Terms. We will update the “Last updated” date. Continued use after changes means you accept the updated Terms. If you do not agree, stop using the App and delete your account.
